Orissa Education Act 1969
No Private educational institution can be established without permission granted in accordance with Section 5 of theOrissa Education Act, 1969 as amended by Orissa Act 13 of 1994. Any person or persons intending to establish a private educational institution shall have to make an application in the prescribed form to the Director with relevant documents between 1st day of July and 31st day of August of the year. After receipt of application the institution shall be inspected and enquired into by the field officials The Director on receipt of such enquiry or inspection report shall place the matter before a Committee for according permission or refusing permission, as the case may be. Any person aggrieved by the decision of the committee shall have right to file an appeal before the State Government
whose decision shall be final and binding. Similarly for recognition the private educational institution so permitted shall have to apply in accordance withSection 6 of the Orissa Education Act. After inspection of the institution and receipt of inspection report with the recommendation of the Director , the application shall be placed before the Committee for according permission or refusing the same. Any person aggrieved by the order of the Committee in the matter of recognition may file review petition before the said Committee for final decision. A private education institution after being permitted and recognised in accordance with Sections 5 and 6 of the Act shall be eligible for affiliation/recognition by the Board of Secondary Education Orissa. The educational need of local area is the main criteria for granting permission and recognition to a private institution. The detailed procedure for application and inspection has been provided in the Orissa Educational ( Establishment, Recognition and Management of Private U.P. Schools) Rules, 1991 in respect of Upper Primary Schools and the Orissa Education (Establishment , Recognition and Management of Private High Schools) Rules, 1991 in respect of High Schools.
